End of week 6 of the 95th Legislative Session

Greetings! We’re at the end of week 6 of the 95th Legislative Session. We completed this past week legislative days 21 though 24.
Cracker barrels – lots of them! Before session last week, we had a cracker barrel in Edgemont at the school gymnasium. It started at 1pm and went to 4pm. At least that’s when I quit visiting with all who attended. What was interesting was that 5 high school seniors from the Government class attended the event. The students asked great questions. They’d been studying bills in their class and were ready for the cracker barrel. I get upset when people say disparaging remarks about our young people. These 5 students were sharp as a tack and represented their school very well.
The other two cracker barrels were on Saturday, one at Western Dakota Tech in Rapid City from 9-11am, and the other in Hot Springs 2-4pm. Here is a quick listing of the questions and bills asked about in all three cracker barrels combined.
1.Question regarding paid family leave. We don’t have a bill regarding this, and question was pertaining to federal law.
2.HB1195 – provide an affirmative defense to pregnant women for certain controlled substance offenses. Basically, not criminalizing a pregnant mother when she tests positive at a doctor’s office, and to provide care for the baby.
3.HB1167 – Revise provisions regarding confidential communications between a student and certain school employees. Addresses school counselors divulging information they obtained from a student to their parents.
4.HB1235 – Revise provisions regarding immunizations. Quote of the day was, “I can’t bring a peanut butter sandwich to school, but I can bring measles.” This is a freedom bill and has a lot of passion on both sides of the issue.
5.Mental health summer study – Basically discussed some type of mental health facility west river so patients don’t have to travel to Yankton for treatment. Is there another location further away?
6.HB1065 – Revise drone surveillance protections.
7.SB151 – Define official infrastructure and revise certain crimes for trespass or damage to critical infrastructure.
8.SB157 – Revise certain provisions regarding the county zoning appeals. This bill has CAFO language: Concentrated Animal Feedlot Operation.
9.Dakota Promise Scholarships. Asking funding questions.
10.SB147 – Prohibit collective bargaining by certain employees of the Board of Regents.
11.HB1215 – Prohibit the state from endorsing certain policies regarding domestic relations. Rep. Randolph was the only sponsor of the bill, so we tabled the discussion on HB1215.
12.One question was asked about a summer study regarding payday loans and what a person asking the question referred to as loan sharks. Probably not going to happen.
13.HB1131 – Prohibit the use of misleading identification for telephonic communication. Passed the House 62 to 0.
Other subjects addressed were:
Fireworks July 3rd at Mount Rushmore. Rep. Frye-Mueller has worked hard here coordinating with the Trump administration, and she also is working with the governor’s office to host President Trump.
In Hot Springs the issue came up that elevators in Wind Cave National Park are not working and have been shut down for over a year! This needs to be addressed on the federal level.
Now, here’s your homework: Google sdlegislature.gov and look through a couple of the bills that interest you. Next, come to a cracker barrel March 7th from 9am to 11am in the Classroom building on the School of Mines and Technology campus. See you then!
