AG Should Resign
Greetings! I was going to write about the status of bills moving through the legislature but after attending 5 cracker barrels (Wall, Hill City, Custer, Rapid City and Hot Springs the past two weekends), I have to write about the proverbial 500-pound gorilla in the room. Well, actually within the borders of South Dakota.
I’m writing about this gorilla without any excitement or glee on my part; its actually more out of sadness and compassion than anything else. Where am I going with this? It’s the Attorney General situation. Unless you’ve been held captive, you’ve had to have heard about the tragedy that has happened involving Joe Boever, his family and friends, and Jason Ravnsborg (pronounced rounsborg).
To recap from my memory, Jason Ravnsborg was returning to his Pierre home after an event in Redfield. At approximately 10 pm on Saturday, September 12, 2020, coming out of Highmore, he hit and killed Joe Boever, aged 55, from Highmore. I’m not going to dive any further into the details of that evening. I think amongst South Dakotans we are pretty much up to speed on that dreadful event. Let’s fast-forward to Feb. 18, 2021. That’s when the Hyde County State’s Attorney’s office announced the following. Our Attorney General, Jason Ravnsborg, will face charges for operating a vehicle while using a mobile or electronic device (cell phone), a lane driving violation (his car was off pavement at the time he struck Mr. Boever), and careless driving. The 3 charges carry a maximum penalty of 30 days in jail and fines of $500 each. Manslaughter and/or vehicular homicide was not charged in this tragic incident. Why it took the Hyde County State Attorney’s office over 5 months to divulge these charges is beyond me.
So, what now? Jason Ravnsborg is innocent until he is proven guilty. In the interim, since the September 12, 2020 accident, he has stayed on as our top law enforcement officer, that being the Attorney General of South Dakota. If these charges result in a conviction, you can speculate that the above-mentioned penalties would apply in the sentencing portion of the trial.
In the Legislature, we could, in the House of Representatives, adopt articles of impeachment just like a criminal charge and then in this case the Senate would hold a trial and could convict. Articles of impeachment need a simple majority vote in the House (36 votes) and conviction would need a 2/3rds vote of 24 votes in the Senate.
So, what’s best for the citizens of South Dakota? My recommendation is that our Attorney General needs to do the honorable thing and resign his post. He needs to do it immediately so we as a state can move forward. Once Jason Ravnsborg has resigned his position, our Governor can appoint a new Attorney General.
