Greetings! Looks like we might be opening up a bit from this covid-19 nightmare we all have been experiencing. Some businesses are opening and trying to comply with CDC guidelines yet still make a profit. I’m going to switch gears and report back to you about legislation I sponsored in the 2020 legislative session.
The first bill I prime-sponsored was HB1079 authorizing an administrative fee for the processing of certain title applications. This was primarily targeted for Pennington County, and Treasurer Janet Sayler and her team, who did a great job testifying in Pierre in House and Senate committee hearings. Results were that it passed the House 66-4 and the Senate 22-1, was signed into law by Gov. Noem.
HB1091 Revise provisions regarding compensation of merchandise dealers for diagnostic warranty work. This passed both chambers unanimously and was signed into law by Gov. Noem.
HB1092 established limited liability for injuries or death of a person engaged in off-road vehicle activity. This was designed to cover folks that 4-wheel in the Hills and the bill mirrored a snowmobile bill that was already on the books. It passed the House 57-11 and the Senate 27-7 and was signed into law by Gov. Noem.
HB1120 authorizes the governing body of a second or third class municipality to act as a planning and zoning commission. It passed the House and Senate unanimously and was signed into law by Gov. Noem.
HB1121 established immunity from liability for the inherent risks of camping. This got defeated in the House Judiciary Committee 10-1. Man, that was a belly flop off the high dive! What was ironic was that this same Judiciary Committee passed limited liability 12-1. I think I went to the well once too often, but just like being a Vikings fan, there’s always next year.
HB1263 Revise certain provisions regarding the dates on which certain school district elections may be held. This was to change what the Rapid City School Board did when they held a bond election for $280 million on Feb. 25 to suppress the voter turnout. The bill would have bond elections on Primary or General Election dates and in June or November on off-election years. It passed the House 38-27 but was defeated in the Senate Education Committee. I made a couple of tactical errors on this bill, but have senators that were against this bill and now are for it with a couple of minor changes. So, bringing it back next year.
SB69 “Revise the penalty for misuse of emblem specialty plates on motor vehicles” passed the House and Senate unanimously and was signed into law by Gov. Noem.
SB51 authorizes the possession of a concealed pistol by employees in a county courthouse. Passed both House and Senate and was signed into law by Gov. Noem.
SB73 Exempt certain persons from the requirement to publish name changes. This bill was targeted for sex trafficking cases, so individuals didn’t have to print name changes in the paper. Their abuser(s) would not then know their new name and track them down. It passed the House and Senate unanimously and was signed into law by Gov. Noem.
SB92 To provide for repurposing STAR academy failed in the Senate 20-14. Dang!
SB95 would have modified certain provisions regarding the repayment of restitution. It failed in the Senate 24-11.
Also was prime sponsor for and passed HC8007 commending the South Dakota Army National Guard’s Ellwein family of Rapid City for being awarded the Association of the United States Army Volunteer Family of the Year Award for 2019!!
I would like to thank all who came to Pierre to testify, emailed me with possible bill recommendations, etc. Without all of your help and support this huge workload couldn’t possibly be done. This wasn’t just me. This was us. It was a true team effort!
