We’ve got 5
weeks down in the 94th legislative session, and 5 more weeks to
go. We (Rep. Frye-Mueller, Sen. Russel
and me) attended two cracker-barrels this last weekend. One was in Custer and one in Hill City. I would like to thank Ron Burtz from the
Custer CountyChronicaland Gray Hughes from the Hill City Prevailer for
organizing and moderating our forums.

It’s always fun to go to cracker-barrels in our district. The citizens that attend are courteous and polite, even if we don’t agree on all the issues. We always leave with a handshake and/or hug and a big smile on our faces. Thank you!
Issues discussed in either Custer or Hill City or both included the following. HB-1251, “Distribute Funds to horse racing out of tourism promotion fund.” HB-1251 is scheduled to appear before the State Affairs committee of which I am a member. It doesn’t look good to me, but will hold my final judgement until the committee hearing.
HB-1117, “Establish immunity from liability for injuries or death in off road vehicle activity.” I am the prime sponsor in the House, and Sen. Russel in the Senate. Steve Johnson from Hill City spearheaded a group to testify before the House Judiciary committee on February 8, 2019. Kudos to that group for outstanding testimony and getting a “do pass” with 8 yeas and 5 nays. It goes next to the House floor for a vote of the 70 representatives.
HB-1110, requiring a penalty (Class 2 misdemeanor) for not getting birth or death certificates. It passed committee 12-1, passed House floor 67-1, now on its way to Senate Judiciary committee.
HB-1217, “Prohibit endangerment of any child by means of driving under the influence”, is scheduled for the hearing of the House Judiciary on 02/11/19. Senator Russel and I are prime sponsors for Mothers Against Drunk Drivers, and are going to be giving proponent testimony.
SB-47, Constitutional Carry, passed the House 47-23, passed the Senate 23-11, was signed into law by Governor Noem, and takes effect July 1, 2019.
HB-1178, “Revise provisions regarding beginning for absentee voting.” No hearings yet. This bill would take absentee voting from 46 days prior an election to 14 days. I’m concerned about our active duty military members. There is also a federal law requiring 45 days for absentee voting for deployed military. I will wait to hear testimony but think we should leave it alone at 46 days absentee voting.
Also of great concern was the nursing home crisis. There was much discussion on this at both cracker-barrels.
The meth epidemic was discussed as was Medicaid expansion.
A couple of funny remarks – In the habitat initiative for pheasants and ducks by Gov. Noem, why didn’t she include elk? We have way more elk in district 30 than pheasants. And – When can I start to collect my bounty money for predators such as skunks, racoon, fox, and coyotes? The answer isn’t WHEN passed, but IF passed, it will probably have an emergency clause on it meaning that it takes effect right after passage. This requires a 2/3rds vote in both chambers. Another funny question – How is the new lady governor getting along? And last but not least, “Have you gotten your mountain lion yet this year?”
Last item: I forgot to mention earlier that the school funding formula was brought up, and how it was negatively affecting our schools in District 30. The example used was the Hill City school district. Over the last 3 years, Hill City schools have lost over 600K with the new formula, and to make matters worse, the district does NOT receive any state aid. Also noteworthy, Hill City students that take the ACT test have the highest scores in the state!!
To the citizens of District 30 and to the men and women in uniform, in honor of all who served, in respectful memory of all who fell and in great appreciation to those who serve today, thank you for giving me the opportunity to serve you.
