A proclamation from the governor
Greetings! Here is the proclamation for the governor declaring a Special Session on October 5, 2020:
“Executive Proclamation, State of South Dakota
Office of the Governor
Proclamation Convening the Legislature
In Special Session During the Year 2020
Whereas, Article IV, Section 3 of the South Dakota Constitution authorizes the governor to convene special sessions of the South Dakota Legislature by Executive Proclamation for the purpose stated in the proclamation; and
Whereas, The Governor deems it necessary and appropriate to convene a special session of the South Dakota Legislature for the important public purpose described herein;
Now, Therefore, I, Kristi Noem, Governor of the State of South Dakota, do hereby proclaim a special session of the South Dakota Legislature will be convened at the State Capitol Building in the City of Pierre, South Dakota, on Monday, the Fifth day of October, 2020, at 10:00 a.m. central daylight savings time. The members of the Ninety-Fifth Legislature are called to the Capitol to attend such special session to transact only the business encompassed by the stated purpose specified in this Proclamation. Such special session shall adjourn sine die no later than 11:59 p.m. central daylight savings time on the Fifth day of October, 2020.
The sole purpose of the special session is to amend the Fiscal Year 2021 budget for the planned expenditure of federal funds relating to coronavirus relief received by the state, and to consider the resolution recommended by the Interim Committee on Appropriations on September 30, 2020.”
What I will be targeting is the portion of the $1.25B that is going to private businesses. Grants will be available for up to $100,000 per qualifying business. The criteria the business must meet is as follows:
*Be located in South Dakota
*Have registered with the secretary of state or the Department of Revenue between September 1, 2019, and June 1, 2020;
*Be open and operating on date of application;
*Demonstrate average monthly income during the period between March 1, 2020, and August 31, 2020, was less than 120 percent of average monthly income prior to March 1, 2020; or that the business operated at a net loss (cash basis) in at least three of the six months between March 1, 2020, and August 31, 2020; and
*Provide a certification that the business is a going concern;
Grant amounts shall be up to twenty percent of the business’s cash expenses (March through August, excluding depreciation, amortization, and noncash expenses) less any “federal aid” which is defined as any Paycheck Protection Program (PPP) funds or other federal COVID grant funding received by the business in 2020;
*Applications proposed to open October 12, 2020, and close on October 23, 2020;
*Once all applications are received, grant awards shall be based on a pro-rata share of available funds; and
*Under current federal law, all funds must be expended by December 30, 2020.
I realize this may be somewhat confusing, but wanted all business owners to be aware of the window for the application process. More to come next week in this article after the special session has concluded.
