Three Ballot Issues Coming Up ...
2 Constitutional Amendments and one Initiative Measure
Greetings! Fall is upon us! Those of us who are blessed to live up in the Hills have had our first snow; 6-8 inches at our place. It has come and mostly gone, but it’s great waking up in the morning to the cool, fresh air that smells so good and goes all the way down to the bottom of your lungs! I love living in the Black Hills!
As stated in last week’s article, we are going to visit about the 3 ballot measures coming up on our ballot this election. Remember, you can vote early at your county courthouse starting Friday, September 18 and up until the day before Election Day on November 3rd.
We have 2 Constitutional Amendments and one Initiative Measure. Let’s start with Constitutional Amendment B – An amendment to the South Dakota Constitution authorizing the legislature to allow sports wagering in Deadwood.
My view is we have already authorized in the city of Deadwood slot machines, card games such as poker and blackjack, craps, keno, and roulette. Sports betting, I think, should be included. My only reservation would be if it’s betting on professional sports only. We don’t need it for amateur sports, especially high school sports. The last thing we need is for it to be available for betting on a Custer vs Hill City sporting event for example.
Voting “yes” on this just allows Deadwood to have sports betting and the legislature (myself and 104 others) set the parameters on what sports are bet on. So, I am going to vote “yes” and urge you to as well.
Next, Initiated Measure 26 – An initiated measure to legalize marijuana for medical use. First off, there already is a legal drug in South Dakota that is medicinal marijuana. It is called Marinol. It requires a South Dakota licensed doctor to issue a prescription and a South Dakota licensed pharmacist to dispense the drug. So, why is this on the ballot? In my opinion, it is to get the proverbial nose of the camel under the tent with the intent to authorize recreational marijuana use. There are a lot of other concerns here including the ability to assist law enforcement, because it (medicinal marijuana) already exists. I’m voting “no”.
Last we have a real train wreck in Constitutional Amendment A – An amendment to the South Dakota Constitution to legalize, regulate and tax marijuana; and to require the legislature to pass laws regarding hemp, as well as laws ensuring access to marijuana for medical use. Just the length and multiple subjects in this amendment should be an automatic “no”. A constitutional amendment, by virtue of state law, requires a single subject. This amendment has hemp, marijuana, and medicinal marijuana in it. If passed, it would surely be defeated in court.
If you’re in favor of our farmers growing hemp, it already passed the legislature and was signed into law. So, we take hemp out of the equation, leaving marijuana and medical marijuana. Did I already mention that this is a train wreck amendment and requires a “no” vote? I’m against legalizing recreational marijuana on a multitude of fronts. One being that even if recreational marijuana was legalized in South Dakota, it is still against federal law. What about drug tests for occupations, and the reasons go on and on.
In closing, I’m not sure if it is the Attorney General’s office or the Secretary of State’s office that is responsible for letting Amendment A on the ballot, but I repeat again this is unconstitutional due to having 3 subjects in 1 amendment. If it takes legislation to tighten this up, please let me know. Vote “no” on Amendment A.
